AG Lawyers Told Judge SOS was Investigating – Documents Say They Weren’t.
(Chuck Muth) – Here’s a question for Secretary of State Cisco Aguilar: How many other double voters is your office sitting on right now?
Because that’s exactly what happened with Charles Spillers Jr.
In June 2023, the Electronic Registration Information Center, known as ERIC, allegedly flagged Spillers to the Nevada Secretary of State’s office. The tip was clear. Spillers appeared to have voted in Potter County, Texas, and in Nye County, Nevada, in the same 2022 general election.
That’s illegal. It’s a felony.
And the SOS did nothing about it. For nine straight months.
We Caught Him. The State Didn’t.
Citizen Outreach didn’t have access to ERIC’s data. We didn’t need it. Using nothing more than public voter registration records and the U.S. Postal Service’s National Change of Address database, we found Spillers ourselves.
We filed a formal Election Integrity Violation Report on March 29, 2024. Only then did the SOS spring into action.
Suddenly there was an investigator assigned. Suddenly there were interviews. Suddenly there was a criminal referral. Spillers eventually admitted to voting twice.
But none of that happened because the state was already doing its job. It happened only because we filed an Election Integrity Violation Report (EIVR) complaint.
They Told a Judge a Different Story
We wanted to know why it took the SOS so long to act, and why so many documents in this case were hidden from us for over a year and a half. So we sued.
The Attorney General’s office fought us every step of the way, calling our lawsuit “frivolous” and “baseless.”
They told the court, over and over, that the SOS was already investigating Spillers before we ever filed our complaint. They said our EIVR “added nothing.”
A judge ordered them to hand over the records anyway.
We finally got them on June 30, 2026. And they tell a completely different story than what the AG’s office said in court.
The documents show no investigative activity on Spillers between the June 2023 ERIC hit and our March 2024 complaint. None.
The official case number wasn’t assigned and even opened until May 2, 2024, more than a month after we blew the whistle.
In other words, if Citizen Outreach hadn’t gone looking, Charles Spillers never gets caught. Period.
What Else Are They Missing?
Now ask yourself the bigger question. ERIC only covers about half the states in the country. What is Nevada doing to catch ineligible voters in the other half – which includes California?
Apparently, nothing.
Citizen Outreach used the same voter roll and postal data method that caught Spillers to flag additional suspicious voting patterns involving non-ERIC states after the 2024 general election.
And we submitted 881 new EIVRs based on this research in early 2025.
The SOS rejected every single one. They claim these aren’t “violation reports.” They call them “challenges” instead – even though they were post-election – and refused to investigate them at all.
Same data. Same method. Same red flags that led to a felony recommendation against Spillers. But according to Secretary Aguilar, “Nothing to see here. Move along.”
The Clock Nevada Ran Out
Here’s what really stings.
Had the SOS handed over these documents when we first asked for them in November 2024, we’d have known a year and a half ago that ERIC hits don’t automatically get investigated.
We could have pushed harder for action on those 881 cases long before now.
Instead, they sat on it. And now Nevada’s 90-day pre-election blackout period kicks in come August. Nothing filed after that gets resolved before the November general election.
That’s not bureaucratic foot-dragging. That’s a state agency running out the clock on its own citizens.
Clean Elections Don’t Happen by Accident
Secretary Aguilar likes to tell Nevadans our elections are clean and transparent. But that’s not what these documents show.
They show a state office that had a documented double voter sitting in its inbox for nine months and did nothing until a private watchdog group forced its hand.
You don’t find fraud by not looking for it. You find it by doing the work. Nevada’s Secretary of State isn’t doing the work.
We are.
If his office doesn’t have the manpower to investigate every credible tip that comes in, fine. We get it.
But then work with us instead of against us. Stop rejecting our EIVRs on a technicality that doesn’t even exist in law. Stop hiding documents we’re legally entitled to.
Because right now, the only thing standing between Nevada voters and an unchecked double voter is Citizen Outreach’s spreadsheet.
That should scare you.
